1. About Us
CellularFin is a South African online retailer of smartphones, smart watches, and accessories. We operate in accordance with the Consumer Protection Act 68 of 2008 (CPA) and all applicable South African law.
2. Orders and Payment
- All prices are in South African Rand (ZAR) and include 15% VAT.
- An order is confirmed only once payment has been received and verified.
- We may cancel an order if stock is unavailable; a full refund will be issued within 3-5 business days.
- Promotions are valid for the stated period only and cannot be applied retrospectively.
3. Delivery
Delivery terms are governed by our Shipping Policy, which forms part of these Terms. CellularFin is not liable for courier delays beyond our reasonable control (e.g. weather, strikes, public holidays).
4. Returns and Refunds
Returns are governed by our Returns Policy, which forms part of these Terms, and comply with the Consumer Protection Act 6-month implied warranty and cooling-off rights for defective goods.
5. Warranty
All products carry the manufacturer warranty. CellularFin will facilitate warranty claims on your behalf, liaising with the supplier and keeping you updated. Warranty claims do not entitle you to an immediate replacement unless the defect is confirmed within 6 months of purchase under the CPA.
6. Liability Limitation
- CellularFin liability shall not exceed the purchase price of the product in dispute.
- We are not liable for indirect, consequential, or special damages (loss of data, lost profits, business interruption).
- Nothing in these Terms limits your rights under the Consumer Protection Act or POPIA.
7. Product Information
We strive for accurate product descriptions, images, and specifications. Minor colour variations may occur due to screen calibration. Specifications are sourced from manufacturers and may change without notice.
8. Intellectual Property
All content on this website is the property of CellularFin or its suppliers. You may not reproduce or distribute any content without prior written permission.
9. Force Majeure
CellularFin shall not be liable for delays caused by circumstances beyond our reasonable control, including acts of God, natural disasters, load shedding, government actions, pandemics, supplier or courier failures, or internet outages. We will notify you as soon as possible and resume performance when circumstances allow.
10. Privacy
Your personal information is processed per our Privacy Policy and POPIA.
11. Dispute Resolution
- Contact us first at support@new.cellularfin.co.za – we respond within 2 business days.
- If unresolved, approach the National Consumer Commission (NCC) at www.thencc.gov.za.
- These Terms are governed by South African law. Legal proceedings shall be in the appropriate South African court.
12. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted here with a revised date. Continued use of our site after changes constitutes acceptance.
